John DiCaro was named to the list of 2011 SuperLawyers for San Diego in the field of Personal Injury Defense: Medical Malpractice.

Andrew J. Osorno graduated from the University of San Diego School of Law and became a member of the California Bar in November 1999.   He joins DiCaro, Coppo & Popcke after a 20-year career in the Navy, during which time he was General Counsel for Naval Hospital Camp Pendleton from 2003-2006 and General Counsel for Naval Hospitals Naples, Italy, Sigonella, Italy, and Rota, Spain from 2006-2008.  His last assignment in the Navy was as a Special Assistant United States Attorney for the Southern District of California Civil Division.   As a SAUSA, he represented the United States in defense of suits filed under the Federal Tort Claims Act.    Andy looks forward to assisting DCP in the defense representation of hospitals and medical staffs facing litigation from disciplined physicians.

Five years after DiCaro, Coppo & Popcke took the Kibler v. Northern Inyo case to the California Supreme Court and convinced the Court to re-write the law pertaining to the legal protections afforded to doctors conducting peer review, DCP has done it again.  Partners Carlo Coppo and Mike Popcke and Associate Shelley Carder persuaded the appellate court in San Francisco to overrule the trial court and grant a dispositive motion in favor of DCP’s hospital client.  The unpublished appellate opinion relied on Kibler and subsequent, related cases in deeming the physicians’ conduct  to be part of the peer review process and consequently protected as such.

On June 28, 2011, John DiCaro and Ashleigh Angeletti won a defense verdict for their Hospital client with an 11-1 verdict after a 7-day jury trial.  Mr. DiCaro and Ms. Angeletti successfully defended the Hospital against claims of professional negligence of the nursing staff in treating a patient in the emergency room. Congratulations, John and Ashleigh!

John DiCaro has been appointed to the Federal District Court Attorney Settlement Panel as a Settlement Officer.  The appointment came after extensive investigation into qualifications.  John has recently expanded his practice to include mediation and arbitration.

February 2011– Associates Lindsey Winthrop and Andrea Maestas have recently joined the firm.  They are recent law school graduattes who distinguished themselves during law school in healthcare law.

Mike Popcke won convincingly in his recent trial in El Centro, garnering a 12-0 jury verdict for his hospital client.  After the case took nearly 5 years to get to trial, Mike showed why the insurance carrier had such confidence in him and his case to wait out trial rather than settling.  Congratulations Mike!
